Kenya’s High Court Unanimously Upholds Ban On Gay Sex

Kenya received some unfortunate news on Friday. Kenya’s high court upheld a law banning gay sex, keeping same-sex relations punishable by 14 years in jail in the conservative East African nation.

Three judges ruled unanimously that the laws, which were introduced by the British colonial administration, should remain in place meaning same-sex relations in Kenya continue to be punishable by years in prison.

Now although gay sex still remains illegal in 72 countries, many people in Kenya had high hopes that history would be made on that day. But, instead were left disappointed after realizing the colonial-era laws won’t be scrapped.

“This is a huge setback for human rights in Kenya,” said Téa Braun, director of the Human Dignity Trust, an international gay rights advocacy group.

Other activists argued that the laws criminalizing consensual same-sex relations between adults are in breach of the constitution because they deny basic rights.
