A Chicago man who bought a 42-pound bag of marijuana-infused chocolates to self-medicate for his cancer has been given four years in prison.

Thomas J. Franzen, 37, pled guilty to possession of 5,000 grams of Marijuana. In the state, it is considered a felony.

The Chicago Tribune reports that the prosecutors dismissed other charges of cannabis trafficking after police discovered his shipment of 430 foil-wrapped THC-infused chocolate bars that were delivered to his home from a medical dispensary in California.

The felony trafficking charge would have landed him 12-60 years in jail. Ironically, Franzen pled guilty a day before the state voted to legalize marijuana.

Franzen’s attorney David Camic said,

“He’s very relieved to have the case over. The judge was cognizant of his health and wanted to give him a break, but ultimately 40 pounds of cannabis is a large amount.”

Franzen has stage three testicular cancer that spread to both his lungs and abdominal cavity, his prison term has been delayed until he has fully recovered.
