The former NYPD who killed Eric Garner by putting him in a lethal chokehold is suing the NYPD to get his job back.

Officer Daniel Pantaleo’s lawyer confirmed the news to NBC News.

As we reported, Pantaleo, was fired back in August for the 2014 murder of Garner. His attorney argued that the decision was “arbitrary and capricious.”

The officer planned to appeal the decision immediately.

“We will file an article 78. We will continue with this case,” his attorney said. “After the article 78, if we need to appeal beyond that we will. We are looking for him to get his job back.”

Police Commissioner James O’Neill fired Pantaleo following the recommendation of a judge. O’Neill said Pantaleo used a banned chokehold on Garner, adding that he could “no longer effectively serve as a New York City police officer.”

Garner’s death caused outrage across the nation. He was a black man killed for selling untaxed cigarettes.
