Parkland school shooter Nikolas Cruz has reportedly filed a motion to remove Judge Elizabeth Scherer from his case.

According to CBS 12, court documents show that Cruz’s legal team think that Scherer is unable to remain impartial in the case because she has been talking to the prosecution.

Cruz’s defense attorneys believe that Judge Sherher and the prosecution have been discussing the case and a “pending defense motion.”

However, the Broward State Attorney’s Office said that this is not true and there was no conversation between prosecutors and Scherer outside of the court.

“Although the judge can only rule on the legal sufficiency of the motion, we can respond to your question by telling you there was absolutely no conversation between any of our prosecutors and Judge Scherer about this case – outside of courtroom proceedings that were conducted in public.”

Cruz’s trial is set to begin with jury selection on Jan. 27. He murdered 17 students and injured many more on February 14, 2018 after going on a rampage at Marjory Stoneman Douglas high school.
