One woman who accused Usher of giving her herpes is blasting the singer for trying to place the blame on her for not bringing a condom during their sexual encounters.
Laura Helm is reportedly demanding that her lawsuit continue on, despite Usher’s attempts to have it tossed out of court. The latest findings come after Helm sued Usher for a second time earlier this year over claims he gave her herpes.
Helm had already sued the “Let It Burn” singer for the same allegations but had dismissed her case voluntarily. Helm claims that she was platonic friends with Usher when he began “overtly and continually seeking a sexual interest” with her. Helm’s says Usher’s advances led to the two sleeping together twice during April 2017; once in Atlanta and once in New Orleans. Helm claims that they used a condom during the first encounter but had unprotected sex the second time.
She says following their sexual encounters, she later discovered bumps on her cheek and in her vagina. Helm eventually went to get tested after reading online that the singer had allegedly settled with another woman over the herpes allegations.
Helm went on to sue Usher seeking unspecified damages and even accused him of assault over claims he forced her to have unprotected oral sex without her consent. However, Usher responded by filing his own legal docs where he demanded the case be thrown out. The father of two claimed that Helm assumed any risks when she allegedly engaged in unprotected casual consensual sex.
He pointed out that she “is silent as to whether she brought a condom to his hotel room, asked him to wear a condom (to which he refused), and/or even discussed the use of a condom or other protection with him.”
Usher also claimed that Helm never told him if she had any STDs or if she had been tested prior to the two hookups. He claimed that she may have been given herpes by a previous sexual partner while denying all allegations of wrongdoing. To add further insult to injury, the “You Got It Bad” singer also asked Helm pay his legal bills in the case.
Helm recently went back to court where she shamed Usher for trying to place the blame on her for not bringing condoms, The Blast reports.
“Defendant audaciously requests this Court to support his self-serving notion that an individual infected with an incurable virus owes no duty regarding his ‘hidden defect’ to a potential sexual partner.”, she stated according to The Blast.
According to the docs, as reported by The Blast, Helm is accusing Usher of trying to place blame on her and blasts him for arguing it’s not his responsibility to warn anybody about his STD status prior to having sexual relations with them.
She further states that for Usher to suggest that she should have brought protection, it shows that he believes the woman is responsible for ensuring safe sexual encounters.
She says his motion to dismiss is nothing more than “a shallow attempt to divert responsibility” away from himself, The Blast reports.
The case remains ongoing while Helm is asking the court not to grant Usher’s motion to dismiss the case.
